Notice of motion.

Mr. Sahil Sharma, DAG Punjab, accepts notice on behalf of the official respondent(s) Learned counsel for the petitioner states that petitioner filed an appeal before the appellate authority against the recovery proceedings initiated against him. However, no decision has been taken thereon. He submits that petitioner shall be satisfied, if the appeal is decided expeditiously. We accept the plea and direct that appellate authority shall decide the appeal at the earliest, in any case not later than six weeks. As regards order, Annexure P-15 whereby security deposited by the petitioner has been forfeited, admittedly, appeal is maintainable before the appellate authority provided under the Act. Learned counsel for the petitioner submits that he would prefer an appeal against the said order within one week from today. CWP-22461-2020 If any such appeal is filed, the appellate authority would entertain the same and take a decision thereon. In case appeal is barred by limitation, petitioner shall be at liberty to move an application for condonation of delay thereof. The plea for condonation of delay shall be considered sympathetically. In view of above, no further direction is necessary. Petition is hereby disposed off.
