(Oral) In the present writ petition, filed under Article 226 of the Constitution of India, the petitioner seeks directions to the respondents to grant the benefit of Assured Career Progression Scheme (ACP Scheme) as formulated vide Policy Circular dated 03.11.2006 (Annexure P-6) and as has been granted to his counterparts by the State of Punjab on the basis of the order passed by this Court on 20.05.2013 in CWP No.16446 of 2010, titled as "Jaswinder Singh Bedi and others vs. State of Punjab and others" (Annexure P-1), which has been upheld by this Court vide order dated 19.12.2014 in LPA No.244 of 2014 (Annexure P-2). It is the case of the counsel for the petitioner that a legal notice dated 21.07.

2020 (Annexure P-9) has been served upon the respondents for the necessary claim(s) and the petitioner would be satisfied if the respondents would take a decision on the same, within a time bound period. VINOD KUMAR 2021.02.

CWP No.22446 of 2020 - 2 - *** It is also submitted that in CWP No.7131 of 2020 titled as "Ramandeep Sharma and others vs. State of Punjab and others", similar directions were issued to the respondents on 25.09.2020 (Annexure P-11). Thus, counsel for the petitioner prays for the similar relief to the petitioner as has been given by this Court in CWP No.7131 of 2020 vide order dated 25.09.2020 (Annexure P-11).

Notice of motion.

On asking of the Court, Ms. Simran Grewal, AAG, Punjab, accepts notice on behalf of the respondents.

Accordingly, without commenting upon the merits of the case, the present petition is disposed of with the direction to the respondents/competent authority to take a decision on the legal notice dated 21.07.2020 (Annexure P-9) within a period of 3 months from today. In case, the petitioner is held entitled for the said relief, the financial benefits be disbursed to him within a period of 2 months thereafter. In case the respondents find that the petitioner is not entitled for the said relief, a detailed speaking order be passed and communicated to him.

Disposed of.
