On 12.01.2026 learned counsel for the respondent had made a statement that the decree stood fully satisfied. However, today learned counsel for the respondent has handed over a copy of order dated 26.11.2025 passed by the Executing Court whereby the execution petition has been ordered to be consigned to Record Room being unsatisfied with liberty to the decree-holder to file fresh execution as and when any other property of the judgment-debtor is available for attachment and to proceed with the execution. 2.

In view of the statement made by learned counsel for the respondent today and the order dated 26.11.2025 passed by the Executing Court, learned counsel for the petitioner states that the present appeal may be dismissed as having been rendered infructuous with liberty to revive in case anything survives in the matter.
