(ORAL) While issuing notice of motion following order was passed :- "It is contended by learned counsel for the petitioner that despite working diligently, no salary has been released to the petitioner from 01.04.2015. Notice of motion returnable by 19.07.2017.

Process dasti only.

In the meantime, in case salary has not been released to the petitioner for the period as claimed, let the needful be done within a period of four weeks on receipt of notice."

Mr. Sharma does not dispute that so far as salary of the petitioner is concerned, the same stands paid. W.r.t. claim of the petitioner for regularization of the service of the petitioner, Mr. Sharma fairly concedes that the petitioner was merely a contractual employee and after DEEPAK KUMAR 2023.02.24 10:23 I attest to the accuracy and integrity of this document

CWP-8461-2017 (O&M) -228th of February, 2017 neither contract of the petitioner was renewed nor any fresh appointment on contract basis has been made. Mr. Soni further submits that now the Water Sewerage Board has already set up a Testing Laboratory where all the water testing is being conducted. Thus, the authorities in their own wisdom have taken decision not to fill the present post.

In view of the aforesaid fact no relief as claimed by the petitioner seeking regularization of the service/extension of contract can be granted.
