***** JASPAL SINGH, J Through instant petition preferred under Article 226/227 of the Constitution of India, petitioner has sought issuance of a writ in the nature of mandamus, directing the respondents to count the daily wages period i.e. 01.03.1977 to 31.12.1978 in Nilokheri Sub Division, 02/1979 to 11/1989 in Taraori Sub Division and also count the work charge period being regular TMate in City Division, Karnal from 1987 to 1989 towards the qualifying serve and refix the pension by counting the same in view of letter/policy dated 26.11.2013 (Annexure P-3) along with interest. 2.

At the very outset of the arguments, learned counsel for the petitioner submits that though legal notice dated 10.12.2017 (Annexure P-4) was duly served upon the respondents but till date neither any response has been received nor any conscious decision has been taken. Without expressing any opinion on the merits of the case, the instant petition is disposed of with the direction to respondent No.1-Managing Director, UHBVNL, Shakti Bhawan, Sector 6, Panchkula to consider the case set up by the petitioner in legal notice dated 10.12.2017 (Annexure P-4) and to take a conscious decision in accordance with law, within a period of three months from the date of receipt of certified copy of this order. In case the concerned authority pass any adverse order, to have recourse to the remedies available under law including filing of writ petition.
