Dated Police Station Sections 22.02.2025 Ranjit Avenue, District Police Commissionerate Amritsar 22/61/85 of NDPS Act (Section 29 of NDPS Act added later on) 1.

The petitioner incarcerated in the FIR captioned above, has come up before this Court under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, [BNSS], seeking interim regular bail for three months.

Counsel for the petitioner seeks interim regular bail on the ground that there is no member except his mother to take care of his wife whose expected date of delivery is 12.07.2025. Counsel further submits that the petitioner would not repeat the offence and live like a decent human being and shall not indulge himself in any offence. 3.

The case was listed yesterday and was adjourned to today and State was asked to get instructions.

State counsel on instructions from ASI Surjit Singh submits that although the mother of the petitioner is there but she is not keeping well. In addition to that, there is no other adult member in the family to take care of petitioner's wife in nurturing and taking care of the baby.

Counsel for the petitioner submits that on earlier two occasions, there were two misJyoti Sharma 2025.07.11 11:36 I attest to the accuracy and authenticity of this order/judgment High Court, Sector 1, Chandigarh carriage of petitioner's wife and now extra caution is required and only for that purpose, interim bail is required.

Given above, provided the petitioner is not required in any other case, the petitioner shall be released on interim bail in the FIR captioned above subject to furnishing bonds to the satisfaction of the concerned Court and due to unavailability before any nearest Ilaqa Magistrate/duty Magistrate. Before accepting the surety, the concerned Court must be satisfied that if the accused fails to appear, such surety can produce the accused. 7.

While furnishing a personal bond, the petitioner shall mention the following personal identification details:

Passport number (If available) and when the attesting officer/court considers it appropriate or considers the accused a flight risk.

The petitioner shall surrender in prison from where he was released, on 01.09.2025 at 10.00 A.M. During the period of interim bail, if the petitioner found involved in any criminal activity, that would be a factor while considering his further bail petitions. 9.

There would be no need for a certified copy of this order for furnishing bonds, and any Advocate for the Petitioner can download this order along with case status from the official web page of this Court and attest it to be a true copy. In case the attesting officer wants to verify the authenticity, such an officer can also verify its authenticity and may download and use the downloaded copy for attesting bonds. 11.

Petition allowed in aforesaid terms. All pending miscellaneous applications, if any, stand disposed of.
