***** JASPAL SINGH, J By virtue of instant petition preferred under Article 226/227 of the Constitution of India, petitioner has sought issuance of a writ in the nature of mandamus directing the respondents to release the remaining amount of retirement-cum-service benefits for the period of service rendered in respondent-department Local Government and Punjab Water supply and Sewerage Division No.2, Bathinda such as gratuity, PF, ACP benefits, DA installments, Arrears of revised pay scale of 01.01.2006 and all other benefits along with interest.

Learned counsel for the petitioner contends that the petitioner joined as Clerk in the month of January 1998 in the Office of Municipal Council, Malout and stood retired on 31.03.2017. He further contends that though legal notice dated 24.01.2018 was duly served upon the respondents but no response has so far been given by the Punjab Water Supply and Sewerage Division No.2, Bathinda. Moreover, she feels satisfied, in case, direction is issued to respondent No.5 to decide legal notice dated 24.01.2018 (Annexure P-2), within some stipulated period. 4.

Without expressing any opinion on the merits of the case, the instant petition is disposed of with the direction to respondent No.5-Executive Engineer, Punjab Water Supply and Sewerage Division No.2, Bathinda to look into the grievances unfolded by the petitioner in legal notice dated 24.01.2018 (Annexure P-2) and to take a final and conscious decision in accordance with law with regard to the release of retiral benefits for the period the petitioner has served with the Sewerage Board after taking into consideration the entire service record for which she remained with the Board and discharged her duties. Needful be done within a period of two months from the date of receipt of certified copy of this order.

However, if the petitioner still feels dissatisfied against the order passed by the concerned authority, she shall be at liberty to have recourse to the other remedies available under law as well as to approach this Court.
