**** RAJ MOHAN SINGH, J. (Oral) The case has been taken up for hearing through videoconferencing. Petitioner seeks grant of anticipatory bail under Section 438 Cr.P.C in case bearing FIR No.73 dated 10.07.2019 registered under Sections 420 and 406 IPC, at Police Station City Morinda, District Rupnagar.

Admittedly the order dated 05.09.2019 has not been complied with so far.

Learned counsel for the petitioner submits that the petitioner is in custody in some other case and due to the aforesaid situation, the amount could not be arranged by the wife of the petitioner.

Learned counsel for the complainant submits that till date nothing has been paid to the complainant, even the original AMANDEEP GOSAIN 2021.09.14 18:36 I attest to the accuracy and integrity of this document

CRM-M-37337-2019(O&M) amount of Rs.2 lacs as agreed in the order dated 05.09.2019 has not been paid so far. Petitioner did not adhere to the obligations even after grant of one more indulgence on 31.01.2020.

Learned State counsel on instructions from ASI Surinder Singh submits that petitioner has not joined the investigation in compliance of the order dated 05.09.2019, as he was in custody in some other case.

Looking to the facts and circumstances of the case, I find no justification to grant any more indulgence in this case. Consequently his petition is dismissed.
