IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH CRM-M-43989-2020 Decided on : 19.07.2021 Chanan Singh . . . Petitioner(s)

Versus

State of Punjab . . . Respondent(s) CORAM: HON'BLE MRS. JUSTICE MANJARI NEHRU KAUL (Through Video Conferencing) PRESENT: Mr. Hakam Singh, Advocate for the petitioner(s).

Mr. Luvinder Sofat, AAG, Punjab assisted by ASI Daljit Singh.

**** MANJARI NEHRU KAUL , J. (Oral) The instant petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No. 124, dated 09.10.20219, under Section 304-B of IPC (subsequently added Section 316 of IPC), registered at Police Station Nurpur Bedi, District Rupnagar. Learned counsel for the petitioner submits that totally vague and false allegations have been levelled against the petitioner of subjecting his deceased daughter-in-law to mental and physical harassment on account of dowry demand. He further submits that the petitioner has been in custody since December, 2019 and there is no likelihood of the trial concluding anytime in the near future. Hence, the petitioner be extended the concession of regular bail.

On the other hand, learned State counsel, on instructions from ASI Daljit Singh, has vehemently opposed the prayer and submissions made by the learned counsel for the petitioner. While drawing the attention of this Court to the allegations levelled in the FIR in question, learned State counsel has submitted that the complainant had categorically stated in the FIR that her deceased daughter JAWALA RAM 2021.07.

CRM-M-43989-2020 - 2 - was being subjected to continuous harassment including physical assault, as a result of which, many a times the matter had to be referred to the Panchayat. Learned State counsel has further submitted that the deceased was in an advance stage of her pregnancy, when she expired on account of consumption of poison. Heard.

Prima facie, there are serious and specific allegations against the petitioner, who is none other than the father-in-law of the deceased. This Court is thus not inclined to extend the concession of bail to the petitioner. Petition stands dismissed. However, anything observed hereinabove shall not be construed to be an expression of opinion on the merits of the case. (MANJARI NEHRU KAUL) JUDGE July 19, 2021 J.Ram Whether speaking/reasoned:
