The jurisdiction of this Court under Section 483 of BNSS, 2023 has been invoked for grant of regular bail to the petitioner in case FIR No. 43 dated 27.4.2023 under Sections 363, 366 IPC and later on added Section 376-Ab IPC and Section 6 of the POCSO Act, 2012, registered at Police Station Majitha Road District Amritsar.

Custody certificate has been filed by the learned State counsel, which is taken on record.

Learned State counsel, on instructions from ASI Amar Singh, submits that charges in the present case were framed on 20.8.2023 and all the prosecution witnesses stand examined and now the case is fixed for defence evidence. Moreover, the victim in her deposition recorded before the learned trial Court, supported the prosecution case. Considering the fact that the trial is at the fag end and especially when the victim, who is aged 12 years, has also supported the prosecution case. Therefore, no ground for grant of regular bail to the petitioner is made out.

As such, the petition is dismissed.

However, the learned trial Court is directed to make endeavour to conclude the trial expeditiously within a period of three months. 7.

Pending miscellaneous application(s), if any, also stands disposed of.
