After arguing for some time, learned counsel for the petitioner submits that the last consideration for promotion of the petitioner from Warder to the post of clerk was rendered by the respondents-department much prior to the year 2011 hence, the respondents are under obligation to see whether, the petitioner can be promoted under 20 % quota from class IV post to Class III post. Hence, the petitioner intend to approach the respondents by giving the details of Class III posts which are lying vacant against which the petitioner can be promoted under 20 % promotion quota and the respondents be directed to consider the said claim of the petitioner and pass an appropriate order in a time bound manner so that the petitioner does not suffer any prejudice.

On advance notice, learned State counsel appears on behalf of respondents-State and submits that in case, any representation is filed by the petitioner raising any grievance, the same will be considered and decided in accordance with law within a period of eight weeks from the date of receipt RIYA 2023.11.17 16:19 I attest to the accuracy and integrity of this document

Learned counsel for the petitioner submits that keeping in view the statement of learned State counsel, the present petition may kindly be disposed of having been not pressed, at this stage, with liberty to file an appropriate representation with respondents.
