Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner, namely Manpreet Singh in case FIR No. 01 dated 01.01.2016, registered under Section(s) 452, 341, 323 & 149 IPC and Sections 3 & 4 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 at Police Station Jhunir, District Mansa. Learned counsel for the petitioner contended that petitioner was earlier admitted to regular bail by the learned trial Court and thereafter, he had been regularly appearing since 2016 and never misused the concession of bail. Thereafter, his bail was cancelled by the learned trial Court on account of his non-appearance on 29.05.2019 as on that date, circumstances were beyond his control and non-bailable warrants of arrest were issued against him. Learned counsel further contended that petitioner is ready to surrender before the learned trial Court and move an application for DEEPAK KUMAR BHARDWAJ 2019.09.05 15:00 I attest to the accuracy and integrity of this document

Notice of motion.

On asking of the Court, Mr. Pawan Sharda, Senior Deputy Advocate General, Punjab accepts notice on behalf of the respondent. A copy of paper-book be provided to him during the course of the day. In view of above, present petition stands disposed of with the directions that in case petitioner surrenders before the learned trial Court within a period of one week from today and moves an application for admitting him to regular bail, the learned trial Judge shall release him on regular bail on his furnishing fresh bail bonds and surety bonds. However, the learned trial Judge shall be at liberty to complete the proceedings under Section 446 Cr.P.C. against the petitioner.
