Status report by way of affidavit of Nirmal Singh, PPS, Assistant Commissioner of Police, Sub-Division Central Commissionerate, Jalandhar, has been filed in Court today. The same be kept on record. Copy thereof has been furnished to learned counsel for the petitioner.

Paragraph no.10 of this status report reads as under: '10.
That thus enquiry officer concluded that this case has been registered by complainant on the basis of wrong facts and therefore the said FIR is required to be cancelled. Finally, the learned ADCP City-1, Jalandhar made his report dated 5.1.2024 and sent to the office of Hon'ble Commissioner of Police, Jalandhar too get the approval of cancelation of FIR. In agreement, the worthy Commissioner of Police approved the same and directed the SHO, PS Navi Baradari to prepare cancellation report accordingly and be submitted to the Court. On the direction of Senior Ashwani Kumar 2024.10.24 18:04 I attest to the accuracy and integrity of this document
CRM-M No.42397 of 2023 -2Officer, the investigating officer prepared and submitted the cancellation report to the learned Magistrate on 27.2.2024 and the same is pending under adjudication. The next date of hearing is fixed as 30.11.2024.' 3.
Having perused the above said status report, learned counsel for the petitioner seeks to withdraw the instant petition with liberty to avail alternative remedy in accordance with law.
