Learned senior counsel for the appellants have been heard at length in this appeal filed under Section 37 of the Arbitration and Conciliation Act, 1996 (for short 'Act of 1996') by the appellant. 2.

Challenge in this appeal is to the order dated 09.08.2024 passed by Court of Additional District Judge (Commercial), Chandigarh whereby dasti notice of the petition under Section 9 of the Act of 1996 preferred by the appellant herein had been issued to the respondent for 20.08.2024 without making any orders qua prayer for interim relief. 3.

It is noticeable from the order dated 09.08.2024, which is challenged herein, that the petition under Section 9 of Act of 1996 filed by appellant herein, is listed before the Court of Additional District Judge (Commercial), Chandigarh for 20.08.2024 which is the next working day. This Court to avoid any prejudice being caused to the concerned Court declines to comment upon merits of the case and leaves it to the Additional District Judge, Chandigarh to atleast decide the question of ad-interim relief made along with the petition under Section 9 of Act of 1996 filed by the appellant, as expeditiously as possible preferably on 20.08.2024 or on any other short date thereafter, as agreed to by the appellant, provided service is complete on that date.

Accordingly, without commenting upon merits of the claim, this appeal stands disposed of.
