This is an application filed under Section 528 of BNSS, 2023, for seeking withdrawal of the main case i.e. CRR-1532-2024. II.

As per the averments made in the application, since, sentence of the applicant-petitioner has completed on 18.01.2025 and thereupon, he has been released by the jail authorities on 18.01.2025, therefore, applicantpetitioner be allowed to withdraw the main case i.e. CRR-1532-2024. III.

In view of the averments made in the application, which is supported by an affidavit of the applicant-petitioner, prayer made therein is allowed, and the applicant-petitioner is permitted to withdraw present case. IV.

Application is disposed of.

CRR-1532-2024 (O&M) - 2 - 2.

Vide Judgment of conviction dated 02.02.2023 and order of quantum of sentence 04.02.2023, learned trial Court held guilty the petitioner - Hari Om, of the following offences and sentenced accordingly:- Under Section Sentence (R.I.) Fine (in Rs.) In Default 279 of IPC Three Months Nil - 304-A of IPC Six Months Nil - 3.

Feeling aggrieved against the said judgment of conviction and order of sentence, petitioner filed an appeal before the lower Appellate Authority, which was dismissed vide judgment dated 05.08.2024. Thereafter, against dismissal of appeal, petitioner has filed the present criminal revision petition before this Court.

Counsel for the petitioner submits that petitioner has already completed the sentence period inside jail, therefore, a conscious decision has been taken by the petitioner to withdraw the present criminal revision petition.
