IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH CWP-19760-2026 Date of Decision : July 03, 2026 DAVINDER SINGH -PETITIONER V/S UNION OF INDIA AND OTHERS -RESPONDENTS

CORAM:

HON'BLE MR. JUSTICE KULDEEP TIWARI

Present:

Mr. Gurfateh Singh Khosa, Advocate for the petitioner.

Mr. Amit Sharma, Sr. Panel Counsel for the respondent No.1.

*** KULDEEP TIWARI, J. (ORAL) 1.

The prayer clothed in the instant writ petition appertains to issuance of directions to respondent No.1 to renew the passport of the petitioner.

2.

For the reasons assigned hereinafter, this Court is not inclined to grant the yearned-for relief to the petitioner. 3.

Admittedly, the petitioner is facing trial in FIR No.25 dated 21.02.2022, registered under Section 420 read with Section 120-B of the IPC at Police Station Sarkaghat, District Mandi, Himachal Pradesh. It is also not in dispute that the petitioner has been declared a "Proclaimed Offender" in the FIR (supra). In terms of Notification No. G.S.R. 570(E) dated 25.08.1993, the petitioner is required, in the first instance, to obtain permission from the trial Court concerned for the issuance/renewal of his passport. However, without approaching the trial Court and obtaining the DEVINDER YADAV 2026.07.03 15:11 I attest to the accuracy and authenticity of this order/judgment

CWP-19760-2026 requisite permission, the petitioner has directly invoked the writ jurisdiction of this Court by filing the instant writ petition. 4.

In the aforesaid circumstances, the instant writ petition is premature and is, accordingly, dismissed.
