MADAAN Present:- Mr. Kshitij Sharma, Advocate for the petitioner. *** Petitioner Surinder Kumar, an employee of Municipal Corporation Ambala feeling aggrieved by the order dated 2.11.2021 dispensing his services has approached this Court by way of filing the present writ petition. He has done so without availing of the departmental remedy of filing appeal provided under Municipal Corporation Employees (Recruitment and Conditions) Service Rules, 1998.

Learned counsel for the petitioner has contended that filing of writ petition under such circumstances is not barred and has referred to the judgment of the Apex Court 'M.P. State Agro Industries Development Corporation Ltd. and another versus Jahan Khan (2007) 10 SCC' in support of his contentions. Under the circumstances of the case, I find that the petitioner should first avail of the departmental remedy. The petitioner is accordingly relegated to the same. The petition stands disposed of accordingly. (H.S.
