The present petition has been filed under Section 482 CrPC for seeking directions to respondents No.2 and 3 for conducting of fair and impartial investigation and to fairly conclude the investigation in the case bearing FIR No.117 dated 28.06.2022 under Section 307, 326-A, 34 IPC, PS Satnali, Mahendergarh.

Learned State Counsel refers to para Nos.4 & 5 of reply dated 21.06.2023, which read thus:- "4.

That during the investigation, the investigating officer has obtained the CDR of mobile no. 9813193168 pertaining to victim Lakhmi Chand alongwith CDRs of mobile no. 9588307979 pertaining to Sanjay i.e. respondent no.4, mobile no. 9929808527 pertaining to Sunil i.e. respondent no.5, mobiles no. 9352957195, 9783044156 pertaining to Sushil i.e. respondent no.6 and mobile no. 9461942222 pertaining to Sandeep i.e. respondents no. 7 w.e.f. 25.06.2022 to 30.06.2022. It is pertinent to mention here that a perusal of the CDRs, Sanjay, Sunil, Sushil and Sandeep were not found present at the place of occurrence on 26.06.2022 and besides this, they have not made any contact with Mob. No. 9467035962 pertaining to accused Rajesh @ Bantu w.e.f. 25.06.2022 to 30.06.2022. As per CDRs the respondents no.

4 to 7, they were not found involved in the present crime alongwith accused Rajesh @Bantu. Thereafter, on 03.09.2022, the verification of facts was got conducted by S.H.O., Police Station, Satnali wherein the respondents no. 4 to 7 were joined in the investigation and found that they were not involved in the present crime and the allegations levelled against them were found false. Thereafter, section 34 of IPC was deleted in the present case. It is Pertinent to mention here that on the same day Suresh son of Tekchand r/o Surheti Jakhal was joined in the investigation who told that on 26.06.2022 at about 10:00/10:30PM, he was going toward VISHAL VARDHAN 2025.11.

-2Satnali from his field, when he heard the noise of crying of a person and reached near the place of occurrence where he saw that one person was going on the motorcycle and a person who was lying in the field near the road was mumbling that Bantu give me motorcycle and mobile phone and after some time his family member reached at the spot and he was taken to hospital.

5. That during the investigation, on 19.09.2022, the investigating officer moved an application to obtain the opinion of the concerned doctor regarding the nature of injury. On 20.09.2022, Dr. Amit Sharma gave his opinion that "After perusal of MLR and BHT dated 27.06.2022 pertaining to injured Lakhmi, the injury no.1 mentioned in MLR is dangerous to life in nature". It is submitted that a fair and proper investigation of the present case has been conducted and after completion of investigation, challan u/s 173 Cr.P.C was presented on 20.09.2022 which has been presented in the Ld. court on 21.09.2022 against accused Rajesh Kumar @ Bantu and now the case is fixed on 17.07.2023 for framing of charges/further order of Hon'ble High Court in the Ld. court of Additional Session, Judge, Narnaul. (Copy of challan u/s 173 Cr.P.C is annexed herewith as annexure R-1/A). It is therefore, most respectfully prayed that the permission may kindly be granted to place the copy of challan on record please." 3.

As it appears from order dated 08.08.2023, passed by learned ASJ, Narnaul, that the application filed by complainant-petitioner for further investigation was withdrawn and the case is fixed for framing of charge. 4.

In view of the above, no further orders are required to be passed.

Pending miscellaneous application(s), if any, stands disposed of accordingly.
