The petitioner a practicing Advocate assails notice dated 27.5.2025 (Annexure P-4) issued by the office of learned Chief Judicial Magistrate, Gurugram directing her to remove encroachment in the Court Complex at Gurugram, which according to petitioner is a 'porta' chamber allotted to him by District Bar Association, Gurugram vide formal allotment letter dated 28.5.2025 (Annexure P-1).

The learned counsel for the petitioner submitted that the petitioner would be satisfied in case she is permitted to submit a detailed representation with regard to the issue in hand to learned District & Sessions Judge, Gurugram and that learned District & Sessions Judge, Gurugram may be directed to consider the same in accordance with law. CWP-19395-2025 (O&M) ( 2 ) claim of the petitioner, the petitioner shall immediately vacate the premises in question and remove the structure existing thereupon at her own costs. 3.

In view of the aforesaid submissions, the instant petition is disposed of with liberty to the petitioner to move a detailed representation to learned District & Sessions Judge, Gurugram with regard to the issue in hand within a period of one week from today. Upon any such representation being submitted, learned District & Sessions Judge, Gurugram shall consider the same in accordance with law and dispose of the same expeditiously by passing a speaking order. 4.

Needless to mention, the petitioner shall remain bound by the statement made by her counsel today before this Court.

A copy of this order be conveyed to learned District & Sessions Judge, Gurugram immediately.
