KARAMJIT SINGH , J. (Oral) Prayer is for grant of regular bail in case having FIR No.85 dated 14.11.2018 registered under Sections 406, 420, 465, 467, 468, 471, 120-B IPC at Police Station Sanour, District Patiala. Hardeep Singh who has appeared on behalf for the petitioner being his real brother submits that petitioner is custody since last more than 3 months and the car loan has already been repaid to the concerned bank and bank issued no due certificate (Annexure P-2). Hardeep Singh further made prayer that the petitioner should released on regular bail. ASI Baljinder Singh who has put in appearance on behalf of State has furnished custody certificate, as per which the custody of the petitioner comes out to be more than 3 months and he is also stated to be involved in two other cases. Hardeep Singh brother of the petitioner submits that in both the said cases the petitioner has been granted bail. ( 2 ) CRM-M-44086-2022 ASI Baljinder Singh has also filed status report by way of affidavit of Gurdev Singh Dhaliwal, DSP Rural District Patiala and the sane is taken on record. As per the said status report coupled with letter dated 2.11.2022 issued by Branch Manager State Bank of India, Sanaur District Patiala, the entire amount of car loan has already been repaid to the bank and the car loan account stands adjusted. ASI Baljinder Singh apprised the Court supplementary challan against the petitioner will be filed within a short period.
I have considered the submissions made by the parties. Admittedly all the offences are triable by the Court of Judicial Magistrate Ist Class and presently the petitioner is lodged in judicial custody and the car loan in question has been already repaid and even after filing of the challan, it will take considerable time for the trial to conclude, so no purpose is going to be served by keeping the accused behind the bars for any longer period.
Thus without commenting on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing bail and surety bonds to the satisfaction of the trial Court/CJM/Duty Magistrate concerned.
