(ORAL) ase heard via  Vide this petition, the petitioner seeks the concession of 'regular bail' under the provisions of Section 439 of the Cr.P.C., upon FIR no.198, dated 24.06.2020, having been registered at Police Station S.G.M. (Sanjay Gandhi Memorial) Nagar, Faridabad, alleging therein the commission of offences punishable under Sections 302 of the IPC, read with Sections 34 and 450 and 120B of the said Code, as also Section 25 of the Arms Act, 1959. Learned counsel for the petitioner submits that the petitioner having been in custody for 1 year and 5 months, with him not even named in the FIR and the only role attributed to him being of allegedly giving shelter to the main accused and having taken them from the place of occurrence, he in any case DINESH 2022.01.06 20:25 I attest to the accuracy and integrity of this document

CRM-M-48074 of 2021 -2deserves to be admitted to bail.

Upon query to learned State counsel, he submits that as per his instructions, the charges are yet to be framed and that the petitioner has been in custody for 1 year and 5 months, though he otherwise opposes the petitioner being admitted to bail in view of the facts and circumstances of the case. Having considered the matter, simply looking at the period of custody of the petitioner, stage of the trial and the allegation against him,  





  

    the petition is allowed and the petitioner is ordered to be released on bail, subject to his furnishing adequate bail bonds and surety bonds to the satisfaction of the trial court.
