In this petition filed under Articles 226/227 of the Constitution of India, the petitioner has prayed for issuance of a writ in the nature of certiorari for quashing the order dated 28.4.2014 (Annexure P-3) to the extent not to deduct 10% amount and to release the amount deposited by the petitioner along with interest.

In pursuance to the public notice issued by the respondents, the petitioner applied for a LIG Flat which was allotted in Housing Board Colony, Sector 4 (Part II), Hisar, vide allotment letter dated 10.10.2013 (Annexure P-1). The petitioner deposited all the dues vide receipts (Annexure P-2 Colly). Respondent No.1 vide letter dated 28.4.2014 (Annexure P-3) cancelled the said allotment. Learned counsel for the petitioner submitted that for the relief claimed in the writ petition, the petitioner has sent a legal notice dated 8.1.2018 (Annexure P-4) to the respondents, but no action has so far been taken thereon.

After hearing learned counsel for the petitioner, perusing the present petition and without expressing any opinion on the merits of the case, we dispose of the present petition by directing respondent No.1 to take a decision on the legal notice dated 8.1.2018 (Annexure P-4), in accordance with law by passing a speaking order and after affording an opportunity of hearing to the petitioner within a period of two months from the date of receipt of the certified copy of the order.
