Learned counsel for the appellant submits that the appellant will pay the entire remaining amount of compensation within six months in three equal instalments. The appellant has already deposited `3 lacs out of amount of compensation. The first instalment of remaining amount of compensation shall be paid on or before 30th of April, 2016 and the remaining two equal instalments will be paid on or before the last day of June, 2016 and August, 2016 respectively.
As the appellant has not challenged the award on merits and has only sought the indulgence of this Court in allowing him to pay the amount of compensation in instalments, the appeal is dismissed. The appellant is allowed to pay the remaining compensation amount as awarded by the Tribunal in three equal instalments as stated above. FAO-6494-2015 -2The order has been passed without notice to the claimants in order to avoid their expenses and unnecessary delay. However, if the claimants are feeling aggrieved by this order, they may move application which on filing be listed in due course.
Registry is also directed to send the amount of `25,000/- deposited by the appellant to the executing Court for being adjusted towards the compensation amount payable to the claimants. ( SURINDER GUPTA ) March 18, 2016.
