(Oral) Prayer is for grant of anticipatory bail to the be petitioner in cross case registered vide GD No.21 dated 1.6.2022 under Sections 307, 325, 506, 34 IPC and Sections 25/27 of Arms Act in case having FIR No.59 dated 29.4.2022 registered under Sections 307, 506, 34 IPC and Sections 25, 27 of Arms Act at Police Station Majitha, District Amritsar. Detailed order was passed by this Court on 23.9.2022 and interim bail was granted to the petitioner with direction to join the investigation.

( 2 ) CRM-M-44082-2022 Counsel for the petitioner submits that the petitioner has joined investigation with the police by virtue of previous order of interim bail passed by this Court.

State counsel on instructions from ASI Bikramjit Singh has not refuted the aforesaid assertions made by counsel for the petitioner and further submits that the recovery of baseball bat is effected from the petitioner and further submits that the petitioner is not required by police for further investigation or for custodial interrogation. Admittedly the present case involves version as well as crossversion and now the petitioner is not required any more for the purpose of further investigation.

In view of the above, without commenting on the merits of the case, the present petition is hereby allowed and order dated 23.9.2022 is hereby made absolute. The petitioner should abide by the conditions envisaged under Section 438(2) Cr.P.C.
