**** SUDHIR MITTAL, J. (ORAL) The petitioner seeks grant of regular bail in case FIR No.75 dated 01.06.2018 registered at Police Station, Bhikhiwind, District Tarn Taran, under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Learned counsel for the petitioner submits that the petitioner was granted interim bail by this Court vide order dated 03.10.2018 as report of the FSL had not been received. After receipt of the report, the petitioner surrendered on 11.07.2018. Charges have been framed but examination of prosecution witnesses has yet not commenced. The petitioner has been in custody for over 10 months and there is no other criminal case pending against him. Thus, he may be granted regular bail. CRM-M-37349-2019 A custody certificate received through E-mail has been produced in Court. The same is taken on record. According to this certificate, the petitioner has undergone actual custody of 10 months and 19 days and there is no other criminal case pending /decided against him. Learned State counsel does not dispute the fact that the examination of the prosecution witnesses has yet not commenced or the fact that the petitioner did not abscond during the period he was on interim bail. Considering the fact that the petitioner has been in custody for over 10 months as well as the fact that trial is not likely to be concluded at an early date, I deem it appropriate to release the petitioner on regular bail. The petition is accordingly allowed and the petitioner is directed to be released on regular bail on his furnishing bail and surety bonds to the satisfaction of the concerned trial Court/Duty Magistrate. 27.01.2020 (SUDHIR MITTAL) Satyawan JUDGE Whether speaking/reasoned Yes/No.
