The learned counsel representing the appellant admits that in view of interpretation of Section 43(5) of the Real Estate (Regulation and Development) Act, 2016, in M/s Newtech Promoters and Developers Pvt. Ltd. v. State of Uttar Pradesh and Others 2021 SCConline SC 1044, the appeal is rendered infructutous as the appellant was praying for the waiver of pre-deposits while filing the appeal and the same be disposed of as such. 2.
Ordered accordingly.

However, the learned counsel representing the appellant submits that the appellant be granted some time to deposit the amount. 4.
Keeping in view the prayer made, the appellant is granted three weeks' time to deposit the amount. If the amount is deposited the Haryana Real Estate Appellate Tribunal at Chandigarh, would proceed to hear the appeal on merits.
