This case has been taken up through video conferencing in the National Lok Adalat in the light of Covid-19 pandemic. The matter has been amicably settled between the parties. The insurance company has offered to pay Rs.3 lakhs over and above the amount awarded by learned Tribunal, in each case, in full and final settlement of claim in this appeal. This offer is acceptable to both the appellants. In view of this amicable settlement, the Insurance Company is directed to deposit cheques of Rs.3 lakhs, in each case, over and above the amount, so awarded by the Tribunal, before the Lok Adalat Branch of the High Court, within a period of four weeks, which shall be handed over to both the appellants. FAO No.5502-2016 and connected case -2In the eventuality of Insurance Company not depositing the cheques, in the given period, then Insurance Company shall be liable to pay penal interest @ 9% per annum from today onwards, on the above stated amount. Accordingly, both the cases stand disposed of. Photocopy of this order be placed on the file of the connected case and a copy of this order be supplied to the counsel/parties and file be returned to the High Court.
