Aggrieved by order dated 7.8.2019 passed by Sub Divisional Judicial Magistrate, Ellenabad, whereby the application filed by the prosecution for reinvestigation/further investigation has been dismissed, the petitioners have come up before this Court under Section 482 CrPC, seeking its quashing. At this stage, learned counsel for the petitioners-complainant submits that they will be contended and satisfied in case they are given liberty to make all their prayers by filing an appropriate petition under Section 482 CrPC and when they file such petition, order dated 7.8.2019 shall not come in their way.

Learned State's counsel has no objection in case this petition is disposed of with liberty aforesaid.

Prayer is genuine. Given above, the present petition is disposed of with liberty to the petitioners to file a fresh petition under Section 482 CrPC by including all their prayers. It is clarified that the order dated 7.8.2019 shall not come in the way of the petitioners while deciding said petition, which shall be decided independently without being affected by principle of estoppel.
