(Oral) The petitioner herein seeks the relief of regular bail in the criminal case arising out of the FIR bearing No.29 dated 10.02.2021 registered at Police Station Haibowal, District Ludhiana, under Sections 341, 323, 506, 148, 149 IPC wherein the offences under Sections 325 and 307 IPC are stated to have been added later-on. As per the allegations as levelled by the complainant in the subject FIR, the petitioner and his co-accused caused injuries to his brother named Sandeep with weapons like datar, sword, bricks etc. Learned State counsel has submitted the custody-certificate of the petitioner in the Court and the same has been placed on the file. I have heard learned counsel for the petitioner as well as learned State counsel in the instant petition and have also perused the file thoroughly.

CRM-M No.48423 of 2021 -2Learned counsel for the petitioner contends that the petitioner is behind the bars since the date of his arrest, i.e 06.05.2021 and no specific injury on the person of the above-named injured has been attributed to him and rather, the injury attracting Section 307 IPC in this case is attributed to the co-accused of the petitioner named Inderdeep Singh @ Franky and in these circumstances, the petitioner deserves the relief as prayed for in this petition.

Learned State counsel does not dispute the afore-referred factual position.

Keeping in view the above-discussed facts and circumstances as well as the fact that the trial of the case is likely to take sufficient time to conclude and without commenting or expressing any opinion on the merits of the case, the petitioner named Mani Singh Notra @ Mani is ordered to be released on regular bail subject to his furnishing the requisite personal and surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/ Duty Magistrate concerned.
