Present petition has been filed under Articles 226/227 of the Constitution of India, inter alia, seeking issuance of a writ in the nature of Mandamus for directing the respondents to consider the grievance of the petitioners with regard to reservation of the seat for the post of Sarpanch of village Kharkuwal, Tehsil Nawanshahr, District Shaheed Bhagat Singh Nagar and further directing respondent No.4 to decide representation dated 08.06.2024 (Annexure P-1) in a time bound manner, as the general elections are likely to be held in September/ October 2024.

2. Learned counsel for the petitioner submits that representation dated 08.06.2024 (Annexure P-1) filed by the petitioner before respondent No.4-Deputy Commissioner, Shaheed Bhagat Singh Nagar (Nawanshahr), Punjab is still pending adjudication.

3. On the other hand, on advance service of copy of petition, learned State counsel appears and opposes issuance of notice of motion. He submits that grievance of the petitioner will be looked into by concerned authority/respondent No.4 and it shall take decision either way, on pending appeal dated 08.06.2024 (Annexure P-1).

4. Given the nature of order being passed, there is no necessity to seek reply by any of the respondents as no further proceedings and/or pleadings are required.

5. Without commenting on merits of the case, the petition is disposed of with a direction to the concerned authority/ respondent No.4 to consider and decide pending representation dated 08.06.2024 (Annexure P1) of the petitioner and pass an appropriate reasoned order, in accordance with law, preferably within a period of 04 weeks from the date of receipt of copy/ production of this order.
