-.- KARAMJIT SINGH , J. (Oral) The petitioner has approached this Court seeking grant of regular bail in a case having FIR No.198 dated 3.9.2011 registered under Sections 279, 304-A IPC and 3/181 of MV Act at Police Station Industrial Area, Chandigarh.

The counsel for the petitioner inter alia contends that the petitioner is behind the bars for the last 6 months and both the offences are bailable and it will take considerable time for conclusion of the trial. ( 2 ) CRM-M-44488-2022 The instant petition is resisted by the State counsel, who has furnished custody certificate of the petitioner, as per which custody comes out to be more than 6 months and 18 days. The counsel appearing on behalf of the UT Chandigarh submits that the petitioner jumped bail and declared proclaimed person and was re-arrested on 31.5.2022 and since then he is incarcerated.

I have considered the submissions made by counsel for the parties.

Admittedly the offences are bailable and triable by Judicial Magistrate Ist Class and the petitioner is in custody for the last more than 6 months. Further, it will take time for the trial to conclude, so no purpose is going to be served by keeping the accused behind the bars for any longer period.

Thus without commenting on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing bail and surety bonds to the satisfaction of the trial Court/CJM/Duty Magistrate concerned.
