NIRMALJIT KAUR, J. (ORAL) After arguing for some time, learned counsel for the petitioner states that the petitioner may be granted one year to vacate the premises with a further undertaking before this Court that he shall give an undertaking even before the learned Rent Controller that he shall vacate the premises on or before 30.10.2020 and shall also pay the rent regularly to the respondent from today onwards till the date of the handing over the vacant possession. Respondent No.1-Maman Chand Gupta, who is also present in Court, has no objection if time of one year is granted to the petitioner subject to his vacating the premises in question on or before 30.10.2020. He has also given a separate statement in this regard. In view of the above, the present revision petition is disposed of with the following directions:- (a) the petitioner will not be dispossessed before 30.10.2020 in case he gives an undertaking before the Rent Controller on
CR-5805-2019(O&M) -2or before 15.11.2019 that he shall hand over the vacant possession on or before 30.10.2020. He shall also pay the arrears of rent, if any, on or before 15.11.2019. (b) He shall also give an undertaking that he will pay the current rent regularly every month.
(c ) In case the petitioner does not give this undertaking by 15.11.2019, the respondent-landlord shall be at liberty to initiate execution proceedings.
(d) In case the petitioner does not vacate the premises by 30.10.2020 in spite of the undertaking, the respondent-landlord shall proceed to file eviction petition as well as at liberty to avail the remedy of contempt.
Disposed of as above.
