The petitioner is working as a Blacksmith in the Municipal Corporation, Chandigarh since 28.05.1987. Though he is concededly entitled to and has been granted promotional pay scales under ACP Scheme but his grievance in the instant writ petition is that no functional promotion has been granted to him so far. The petitioner, thus, claims himself to be stagnated for the last more than 30 years. He made a representation to the authorities whereupon Executive Engineer, Roads Division No.2, M.C., Chandigarh vide Memo dated 15.06.2016 (Annexure P-10) requested the Superintending Engineer (B&R) of the Municipal Corporation, Chandigarh that the petitioner may be promoted as Charge Man Grade-II in terms of Chandigarh Administration Notification dated 02.07.2004 and if need be, the Meenu 2017.05.10 15:34 I attest to the accuracy and authenticity of this document chandigarh

[2] No decision appears to have been taken by the higher authorities on the above-stated recommendations. [3] In this view of the matter, we dispose of this writ petition with a direction to the Superintending Engineer/Chief Engineer or the other higher authorities(B&R) of the Municipal Corporation, Chandigarh to take an appropriate decision pursuant to the recommendations dated 15.06.2016 sent by the Executive Engineer. It shall be appreciated if final decision is taken within three months from the date of receipt of a certified copy of this order.
