Present:

Ms. Jyoti Sarin, Advocate for the petitioner. JASWANT SINGH, J (ORAL) The petitioner was recruited as Lecturer in Mechanical Engineering by way of direct recruitment against the post reserved for Physical Handicapped Category on 19.2.2010. With regard to the next promotional post i.e Senior Lecturer (Mechanical) Engineer governed by the Punjab Department of Technical Education and Industrial Training (Technical Education Wing) Group A, Service Rules, 2001, there is promotion quota of 75% in the said Rules and as per Appendix B, at least five years experience as Lecturer in Engineering is required for being eligible for promotion on the criteria of Merit-cum-seniority. It is stated that in the cadre strength of 31 qua Senior Lecturers, 23 would fall under the promotional quota whereas only 22 in that quota are in place. It is claimed that the solitary said vacancy would fall to the category of Physical Handicapped as per the Roster Point, and the petitioner being the only eligible candidate is entitled to be considered for the said promotion against the said vacancy.

At the time of hearing, learned counsel for the petitioner submits that she would be satisfied if her legal notice

CWP No.8992 of 2017 #2# (P.7) is directed to be decided within a particular time frame. Prayer being reasonable is accepted.

Without adverting to the merit of the claim raised by the petitioner, present petition is disposed of with a direction to the Competent Authority to decide the legal claim as set out in the legal notice (P.7) by passing a speaking order within four months of receipt of certified copy of this order, in accordance with law.
