This petition has been filed under Section 528 of BNSS seeking the issuance of appropriate order or direction to ld. JMIC, Faridabad to decide the complaint i.e. CIS NO. NACT/5983/2017 filed by the complainant decided expeditiously and in a time bound manner.

Learned counsel representing the petitioner asserts that the complaint filed under Section 138 of the Negotiable Instrument Act has been pending since 2017 and is repeatedly being adjourned at the request of the accused without any legitimate justification. He further states that he is 85 years old and is suffering from Stage 3 Oral Cancer. He further submits that the accused is merely prolonging the trial under various pretexts. The current case was declared as an Action Plan Case on 01.08.2024. The accused continues to submit applications under Section 145(2) of N.I.Act read with 311 of the Cr.P.C. Even the complainant has filed no objection to such applications in order to expedite the trial but the trial is not proceeding further. Keeping in view the facts and circumstances of the case and the limited prayer made by the petitioners, the present petition is disposed of with a direction to ld. trial Court to look into the matter and conclude the trial expeditiously within a period of six months.
