***** JASPAL SINGH, J Through instant petition preferred under Article 226/227 of the Constitution of India, petitioners have sought issuance of a writ of certiorari, mandamus or any other appropriate writ, order or direction, directing the respondents to count the work charge service/daily wages towards regular service and grant pensionary benefits such as pension, gratuity, leave encashment, commutation of pension alongwith interest by recasting the service book to include the daily wage services.

At the very outset of the arguments, learned counsel for the petitioners submits that though legal notice dated 11.08.2017 (Annexure P-2) was duly served upon the respondents but till date no action has been taken by the respondents. He further submits that petitioners feel satisfied, in case, direction is issued to respondent No.2 to decide aforesaid legal notice, within Sonika 2018.03.15 17:07 I attest to the accuracy and authenticity of this document Chandigarh

Without expressing any opinion on the merits of the case, the instant petition is disposed of with the direction to respondent No.2-Registrar Cooperative Societies Haryana Bays No.27-30, Sector 2, Panchkula to look into the grievances unfolded by the petitioners in legal notice dated 11.08.2017 (Annexure P-2) and to decide the same particularly in view of judgment passed by Hon'ble Supreme Court captioned as "State of Haryana and others vs. Kesho Ram" in Civil Appeal No. 1772 of 2009, within a period of three months from the date of receipt of certified copy of this order. 4.

However, if the petitioners still feel dissatisfied against the order passed by the concerned authority, they shall be at liberty to have recourse to the other remedies available under law as well as to approach this Court.
