-.- JAISHREE THAKUR J. (ORAL) This is a petition that has been filed for grant of regular bail in case FIR No.49 dated 16.05.2019 under Sections 420, 376 IPC registered at Police Station Division No.4, Ludhiana.

Learned counsel appearing on behalf of the petitioner contends that in fact matter between the petitioner and the complainant has been settled wherein petitioner had agreed to marry the prosecutrix within one month from the date, interim bail had been granted to him. It is submitted that pursuant to the order dated 11.09.2019, petitioner herein was released on interim bail and has performed marriage on 05.01.2020 and therefore, prays for the interim bail to be converted into a regular bail. Parties are present in Court and on the asking of the Court, the complainant informed that they are residing together happily. I have heard learned counsel for the parties. CRM-M No.37684 of 2019 -2between the parties by way of marriage having been performed by them and the trial is likely to take some time to conclude, no useful purpose would be served in keeping the petitioner behind the bars. The instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal bond and surety bond to the satisfaction of concerned trial Court/Duty Magistrate, however, with the condition that in case the petitioner abandons the complainant, she would be at liberty to move an appropriate application for having this order recalled.
