Tribhuvan Dahiya, J (Oral) The petition has been filed, inter alia, seeking a writ of certiorari quashing the impugned objection letters, dated 10.02.2022, Annexure P-5 and 18.08.2022, Annexure P-6, issued by the respondents, whereby objections have been raised regarding the petitioner's claim for grant of benefit of second Assured Career Progression Scheme (ACP) on the ground that he is ineligible for promotion to the post of Elementary School Head Master (ESHM).

Learned counsel for the petitioner submits that grievance raised herein is pending for appropriate decision before the second respondent. At this stage, the petitioner will be satisfied in case the second respondent is directed to decide his pending legal notice, dated 10.06.2024, Annexure P-21, in a specified period.

In view thereof, without going into the merits of the case, the petition is disposed of with a direction to the second respondent-Director, Elementary Education, to consider and decide the legal notice, dated 10.06.2024, by passing a speaking order in accordance with law, within a period of three months from receiving a certified copy of this order. 6.
In case the petitioner is found entitled to the claimed benefit, the same shall be released within two weeks thereafter. 7.
