Prayer in the present petition, filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), is for grant of interim bail for four days (16.08.2024 to 19.08.2024) to the petitioner in FIR No.494 (Annexure P-1), dated 23.10.2023, under Sections 302, 148, 149 IPC, registered at Police Station City Barnala, District Barnala, on the ground of getting preparations done to send his daughter abroad and to meet her. 2.
Learned counsel for the petitioner has submitted that daughter of petitioner has been granted Study Visa for Canada from 04.07.2024 to 30.09.2026 and her flight from Indira Gandhi International Airport, Delhi is scheduled for 18.08.2024. Photocopies of his daughter's Passport, Visa, Air Ticket etc. have been annexed with the present petition.

On the other hand, pursuant to advance notice supplied to the office of Advocate General, Punjab, Ms. Manjot Kaur, AAG, Punjab is present to assist the Court. Learned State counsel has opposed the petition on the ground that the allegations against the petitioner are grave and serious. The injuries attributed to the petitioner in a scuffle, in which he was participating very actively, resulted in death of a police official, who was on duty. So, the petitioner does not deserve any leniency from the Court. 4.
I have heard learned counsel for the parties and perused the case file.

According to version of the prosecution, the petitioner is alleged to have played an active role in the occurrence in question. However, he has moved the present petition for interim bail on the ground that there is no one else in the family to get the preparations done for his daughter who is going abroad. The said prayer of the petitioner has no weight to support him as all the preparations have already been done, all official correspondence like Visa, Ticket Booking etc. have already been finalised, copies whereof have been placed on record by the petitioner himself. So, it cannot be presumed that any such task is yet to be completed, which cannot be done without the presence of the petitioner. Therefore, this Court is of the view that there is no ground to release the petition even on interim bail as the allegations against him are not simple. The occurrence in question revolves around death of a police official on duty, which cannot be taken in a casual manner. 6.
Accordingly, the present petition is without any merit and the same is accordingly dismissed.

However, nothing observed herein above shall be construed to be an expression of opinion on the merits of the case. The observations recorded above are only for the purpose of deciding the present petition. 8.
Pending applications, if any, shall stand disposed of along with this judgment.
