Mr. Amit Jhanji, Advocate, for respondent No.3. **** Rajan Gupta, J. (Oral) Petitioner has posed a challenge to the order dated 28.03.2017 passed by the Divisional Commissioner, Gurugram. It has been urged that the Commissioner had no jurisdiction to direct an enquiry into inter se dispute between the petitioner and respondent No.3. Learned State counsel, at the outset, submits that the enquiry, if any, shall be conducted for examining evasion of stamp duty. He seeks to place on record a short affidavit of Dr. D. Suresh, Divisional Commissioner, Gurugram, in this regard. Same is taken on record. In view of the above, impugned order is hereby set aside with liberty to the authority to pass a fresh order as per law. Disposed of.
