The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents No. 2 and 3 to re-issue his passport.

The petitioner was issued passport on 24.04.2012 which expired on 23.04.2022. The petitioner applied for re-issuance of passport. An FIR No. 118 dated 28.08.2020, under Sections 325, 427, 506 and 34 of IPC was registered against the petitioner at Police Station, Pasiana, District Patiala. The police after completing investigation has filed cancellation report which has not been accepted by trial court and trial court has asked the police to make further investigation.

Learned State counsel, on instructions from ASI Gavinder Singh, submits that it is factually correct that except aforesaid FIR, no other FIR is pending against the petitioner and police after completing investigation has filed cancellation report.

This Court vide judgment in Mohan Lal @ Mohna vs. Union of India and others, CWP No. 27167 of 2018 decided on 14.07.2023 has disposed of identical issue.

On being confronted with the aforesaid fact, learned counsel for Union of India concedes that facts of the present case are identical to case of Mohan Lal @ Mohna (supra). He further submits that competent authority would pass an appropriate order within six weeks from today. 6.
In the wake of statement of learned counsel for Union of India, the petition stands disposed of.
