Narinder Singh v. State Of Punjab & ORS
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CWP No. 9123 of 2017 Date of decision : 11.07.2017 Narinder Singh ....Petitioner V/s State of Punjab & ors.
....Respondents BEFORE : HON'BLE MR. JUSTICE RAJAN GUPTA
Present:
Mr. Balbir Singh Saini, Advocate for the petitioner. Mr. Aditya Sharda, AAG Punjab.
Mr. Akshay Jain, Advocate for respondent no. 3. RAJAN GUPTA J.
Learned counsel for the petitioner submits that he was granted licence No. 1656 dated 09.10.1994 for typing work in the court premises at Patiala. His grievance is that his licence has been cancelled vide order dated 12.04.2017 without affording any opportunity of hearing to him. It has been urged before the court that the petitioner has no other means of livelihood. In case order, Annexure P2 stands, he would be rendered jobless.
Perusal of the order, Annexure P2 shows that same has been passed unilaterally by the authority without affording any opportunity of hearing to the petitioner. Under the circumstances, same is hereby set-aside. The authority shall pass a fresh order after granting an opportunity of hearing to the petitioner.
Petition is allowed in these terms.
