CWP-19390-2025 -1IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH 267/3 CWP-19390-2025 Decided on: 17.03.2026 PUSHPA DEVI AND OTHERS ... PETITIONER(S) VS STATE OF HARYANA AND ANR.

... RESPONDENT(S)

CORAM:

HON'BLE MR. JUSTICE SANDEEP MOUDGIL

Present:

Mr. Karan Ranjha, Advocate for the petitioners. Mr. Teevar Sharma, DAG, Haryana.

***** Sandeep Moudgil, J.(Oral) Instant writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of writ in the nature of Certiorari quashing the impugned communication dated 08.07.2025 (P-5), which is in violation of online transfer policy dated 25.11.2021 (P-1). 2.

Written statement dated 19.08.2025 was filed by the State through Mohinder Singh, Under Secretary to Government of Haryana, Public Health Engineering Department, Haryana on behalf of respondents No.1 and 2 after notice of motion was issued by this Court vide order dated 14.07.2025. 3.

It is a matter of record that the petitioners were not transferred under the Transfer Policy dated 25.11.2021 as well and were transferred as per Online Transfer Drive-2024.

4.

Once the new Policy dated May, 2025 has come in place, the writ petition has become infructuous as no cause of action would survive under the Policy, which is not in existence particularly in the light of fact that petitioners were not transferred at all in that Policy.
