Dated Police Station Sections 28.06.2019 Barwala, District Hisar, Haryana 148/149/302 of IPC, 1.

The petitioner incarcerated in the FIR captioned above, has come up before this Court under Section 483 BNSS, 2023 for grant of regular bail along with the application bearing CRM-26428-2025 for interim bail on medical ground also filed. 2.

Counsel for the petitioner submits that at this stage, he restricts his prayer qua interim bail on medical ground as petitioner is hospitalized. 3.

Counsel for the petitioner submits that while granting interim bail to the petitioner vide order dated 16.05.2025, this Court had observed that in case, petitioner's health does not improve then he shall be permitted to file a fresh petition for regular bail without surrendering and refer to paragraph No.12 in this regard, which reads as follows: "xxx xxx xxx xxx CRM-19561 stands allowed to the extent above. It is clarified that no application for extension of interim bail shall be filed in the present petition. Main petition stands disposed of with liberty to file fresh after surrender. However, in case petitioner's health does not improve then he shall be permitted to file a fresh petition for regular bail without surrendering. All pending miscellaneous applications, if any, stand disposed of."

State counsel submits that the petitioner is hospitalized, however, he has already been operated.

Given above, provided the petitioner is not required in any other case, the

CRM-M-36654-2025 (O&M) -2petitioner shall be released on interim regular bail in the FIR captioned above subject to furnishing bonds to the satisfaction of the concerned Court and due to unavailability before any nearest Ilaqa Magistrate/duty Magistrate. Before accepting the surety, the concerned Court must be satisfied that if the accused fails to appear, such surety can produce the accused. It is for the concerned Court to take fresh bonds or continue the earlier one furnished by petitioner and his surety.

While furnishing a personal bond, the petitioner shall mention the following personal identification details:

Any observation made hereinabove is neither an expression of opinion on the merits of the case nor shall the trial Court advert to these comments. 8.

The petitioner shall surrender in prison from where he was released, on 31.07.2025 at 11.00 A.M.

There would be no need for a certified copy of this order for furnishing bonds, and any Advocate for the Petitioner can download this order along with case status from the official web page of this Court and attest it to be a true copy. In case the attesting officer wants to verify the authenticity, such an officer can also verify its authenticity and may download and use the downloaded copy for attesting bonds. 10.

The present petition stands disposed of. However, in case, petitioner's health does not improve, he will have to surrender first in the concerned jail and in such an event, the State shall admit him to the hospital after surrender and after that petitioner shall be permitted to file a fresh petition for regular bail supported by all medical evidence.
