This is a petition under Article 226 of the Constitution of India for issuance of a writ in the nature of Mandamus directing the respondents to release the petitioner on parole/furlough for a period of two weeks as per Section 3 of the Haryana Good Conduct Prisoners (Temporary Release) Act, 2022, in FIR No.316 dated 18.04.2008, registered under Sections 302, 307, 212, 216, 148, 149 and 120-B IPC, at Police Station Sadar Hisar, District Hisar.

The petitioner was convicted in the aforesaid FIR and is in custody since 26.04.2008. He has submitted representation dated 08.09.2022 (Annexure P-3) to the Deputy Superintendent of Central Jail-I, Hisar, Haryana, seeking two weeks' parole. After ten days, the present petition has been filed without waiting the decision on the said representation.

After arguing for some time, learned counsel for the petitioner prays for withdrawal of the instant petition, with liberty to file a fresh one on the same cause of action, if the need so arises at later stage.
