The present appeal has been filed against the award dated 15.12.2014 passed by Motor Accidents Claims Tribunal, Hisar (hereinafter referred to as the 'Tribunal').

On 17.04.2009, Sandeep, aged 22 years, lost his life in an accident. He was travelling in Mahindra Logan bearing registration No.HR20P/4694 which was driven by Vikrant son of Jasbir Singh. The said car was being driven in a rash and negligent manner. When they reached near village Talwandi, the car struck against neelgai which was crossing the road. Due to the accident, Sandeep suffered multiple and grievous injuries. He was shifted to Sapra Hospital where he lost his life.

The claim petition under Section 166 of the Motor Vehicles Act, 1988 (for short, 'the Act') was moved by the mother and minor daughter of the deceased.

FAO-6940-2015 -2The Tribunal after considering the witnesses and evidence, awarded a sum of Rs.7,23,800/- alongwith interest of 7% per annum. I have heard the learned counsel for the parties and have perused the paperbook with their able assistance.

Learned counsel for the Insurance Company on instructions from his clients has offered another amount of Rs.1.50 lacs to the claimants. Learned counsel for the appellants on instructions from his clients has agreed to the said enhancement.

In view of the above settlement, there is no issue left in the appeal for further adjudication.

The claimants be paid the amount of Rs.1.50 lacs along with interest as awarded by the Tribunal within four weeks from today. The appeal is disposed of accordingly.
