JUSTICE AMIT RAWAL -.- AMIT RAWAL J.(ORAL) The contention of learned counsel appearing for the petitioner is that against the order of eviction passed under Sections 4, 5 and 7 of the Punjab Public Premises (Eviction & Rent Recovery) Act, 1973, the petitioner has preferred an appeal before the Competent Authority under Section 9 on 25.04.2017 along with application for interim order but the same has been listed for 17.05.2017. However, in the meantime, vide Annexures P-1 to P-4, warrants of possession have been issued on 27.04.2017.

Keeping in view the facts and circumstances of the case, particularly, when the statutory remedy of appeal has been availed with an interim relief, I deem it appropriate to direct the Joint Development Commissioner-cum-Appellate Authority to consider the prayer of interim stay within one week from the date of receipt of certified copy of this order.
