RAJESH BHARDWAJ, J.(ORAL) Instant writ petition has been filed under Articles 226/227 of the Constitution of India praying for issuance of writ in the nature of mandamus directing official respondents to appoint the petitioner as the Mahant/Mohtmim of Dera Shri Guru Ravidass Mandir Sachkhand, Village Chak Hakim, Tehsil Phagwara, District Kapurthala and the Muafi land measuring 158k-9m in village Phagwara Garbi, Tehsil Phagwara, District Kapurthala in terms of Farman-i-Shahi and the judgment of this Court in State of Punjab vs Mahant Jatinder Dass Chela Narotam Dass 2015(3) RCR (Civil) 476.

It has been contended by counsel for the petitioner that representation, Annexure P-3, was filed by the petitioner before respondent No.2 on 21.02.2023, but no decision has been taken on the same till date. Notice of motion to official respondents only at this stage. On asking of the Court, Ms.Akshita Chauhan, Deputy Advocate General, Punjab, who is present in Court, accepts notice on behalf of the MEENU 2023.08.28 17:24 I attest to the accuracy and integrity of this order/judgment

After hearing counsel for the parties and going through the facts and circumstances of the case, the present petition is disposed of with a direction to respondent No.2, i.e. Deputy Commissioner, Kapurthala, to decide the representation, dated 21.02.2023, Annexure P-3, expeditiously in accordance with law preferably within one month from the date of receipt of certified copy of this order.
