Rajan Gupta, J (Oral) Petitioner has sought a direction to the respondent to consider the case of husband of the petitioner for remission/premature release who is undergoing sentence for having been convicted under Sections 342, 364 & 302 IPC . At present, he is detained in Central Jail, Amritsar. On the last date of hearing, a copy of the petition was handed over to learned State counsel to enable him to get instructions and assist the court. Today, he submits that case of the petitioner was considered by the competent authority. It was found that he is not entitled to the relief prayed for and order was passed which was forwarded to the DGP, Punjab. Copy thereof shall be furnished to the petitioner within one month from today.
In view of stand taken by the State, no case for interference in the writ jurisdiction is made out. Dismissed. However, petitioner shall be at liberty to file a fresh representation as and when cause of action arises. (Rajan Gupta) Judge July 18, 2017.
