RAJESH BHARDWAJ, J.(ORAL) Petitioner has approached this Court praying for issuance of directions to the respondents to change the name of City Enclave/Green Avenue Colony, Raikot, District Ludhiana, in the name of father of the petitioner, namely, Freedom Fighter Pandit Devi Dayal in view of resolution No.264 passed by the Municipal Council, Raikot, District Ludhiana, which was duly approved by the General House of the Municipal Council, Raikot in its meeting held on 10.09.2019, vide Agenda Item No.7. Learned counsel for respondent No.4 has submitted that though in the earlier resolution dated 10.09.2019 passed by the respondent-M.C. it was resolved to change the name of the society in the name of father of the petitioner, however, now the M.C. has passed the fresh Resolution No.198, dated 07.09.2023, in view of the objections raised by the residents of that MEENU 2023.12.18 14:52 I attest to the accuracy and integrity of this order/judgment

-2society and has rejected the claim made by the petitioner. He has submitted that the same has been sent to the Government for its concurrence. After hearing learned counsel for the M.C., it is apparent that now fresh resolution, dated 07.09.2023, has been passed rejecting claim of the petitioner. Thus, the petitioner has now fresh cause of action in view of the above mentioned fresh resolution dated 07.09.2023. Hence, the present petition is disposed of with liberty to the petitioner to avail his alternative remedies as available to him in pursuance to the fresh resolution dated 07.09.2023 passed by M.C., in accordance with law.
